Minutes of the Meeting of September 12, 2012

Chairman Burton Kaplan called the meeting to order at 7:00 PM.
APPOINTMENTS
7:15 PM – Doug Karson – AFCEE Annual MMR IRP Update.
Doug Karson, of the Air Force Center Engineering and Environment at Otis, introduced himself to the Board and provided a thorough update on the clean-up efforts being provided by his agency in Mashpee including updates on the chemical and fuel spills affecting the local ponds and cranberry bogs. Mr. Karson provided maps, charts, and hand-outs to the Board and to Mr. Harrington for the Board of Health office. Progress continues to be made in the clean-up of the plumes from the Base affecting Mashpee.
7:30 PM – Mark Tolley, US Sports Institute – Recreational Camp Violations.
Burton Kaplan stated that the US Sports Institute had requested a continuance. Continuance was granted.
8:00 PM – Falmouth Engineering – 76 Triton Way – Title V Variances: Septic Repair.
Michael Borselli, of Falmouth Engineering Inc., introduced himself to the Board.
Mr. Borselli is representing the applicant, M. C. Development, Tony Caruso. Mr. Borselli is requesting variances from Title V to proceed with an upgrade and repair of a substandard septic system at the property at 76 Triton Way, which has an existing 4-bedroom single family dwelling located on the property.
Mr. Borselli stated that the existing system does not have the required size septic tank, and it has two leaching pits. The inspection revealed that the leaching pits are not on the property. They are located within the cul-de-sac on Triton Way.
Mr. Borselli commented that a topographic survey of the property was performed, the top of the coastal bank was delineated, and a boundary survey was done. The plumbing of the house was investigated, and the best course of action would be to install an infiltrator system between the house and both the road property line and the neighbor’s property line. The plumbing will be re-routed to install a new 1500-gallon septic tank, pipe from the tank to the D-Box and then feed the infiltrators. It will all fit on the lot, but property line variances are required.
Michael Borselli commented that once the tank is installed the rest of the system would be a relatively shallow excavation. Most of the work would be done by hand. The abutters were notified, as required, by certified mail, and the return receipt green cards were provided to the Board.
The first variance is to allow the septic tank to be less than 10 feet to a property line, an eight-foot variance is sought. The second variance is to allow the septic tank to be less than 10 feet to the cellar wall. A variance of 4 ½ feet is requested. The variance requested to the property line is 7.6 feet to the road layout, and a 4.6 foot variance to the abutting property line. The final variance requested is the S.A.S. to the cellar wall of 13.4 feet. A waterproof membrane is proposed to mitigate any problems.
Lucy Burton made a motion that the Board of Health approve the variances as requested for 76 Triton Way. Kalliope Egloff seconded the motion. The motion was unanimously approved.
8:15 PM – Allied Waste Services of Cape Cod – Recycling Regulation.
Burton Kaplan stated that Lakeside Estates has agreed to the installation of a recycling container to be emptied on call. This will bring Lakeside Estates into partial compliance as part of the settlement agreement.
NEW BUSINESS
1. Sign Warrants. Board members signed the warrants.
2. Review/Approve BOH Public Session Minutes: July 25, 2012, and August 8, 2012.
Lucy Burton made a motion that the Board of Health approve the Minutes of July 25, 2012. Kalliope Egloff seconded the motion. The motion was unanimously approved.
Kalliope Egloff made a motion that the Board of Health approve the Minutes of August 8, 2012. Burton Kaplan seconded the motion. The motion was unanimously approved.
3. Emergency Dwelling Condemnation: 68 Harwich Road.
Glen Harrington stated that the property has been purchased. A new septic system will be installed, and building, plumbing, and electrical permits will be issued.
Lucy Burton made a motion that the Board of Health reaffirm the condemnation of 68 Harwich Road in Mashpee. Kalliope Egloff seconded the motion. The motion was unanimously approved.
OLD BUSINESS
1. Health Agent’s Update – 26 Collins Lane, 22 Greensward Road, 43 Brassie Way,
84 Captains Row, 24 Spoondrift Way.
Glen Harrington stated that a contractor, representing the owner of 26 Collins Lane, came to the Building Department on July 11, 2012. The entire building, including the lower level, was boarded up. The trees and brush around the house were bull dozed and cleared. The building was secured. The police now have access to the back of the house where suspected illegal entry had been obtained.
Glen Harrington commented that 22 Greensward Road was the property where the septic tank was difficult to access. Brian Reyenger was the septic installer for this property. A concrete truck was parked in the front yard, a chute was placed between the house and the garage, and then wheel barrels were used to bring the concrete through.
Mr. Harrington stated that the house at 43 Brassie Way has not sold. Nothing will take place until the house sells.
Mr. Harrington commented that 84 Captains Row was a sale property with cesspools. An Enforceable Agreement was provided on August 29, 2012. Everything was forwarded to the attorneys for transfer of the property.
Glen Harrington stated that he does not have any updates for 24 Spoondrift Way.
ADDITIONAL TOPICS
1. Glen Harrington commented that the Mashpee Pop Warner Concession Stand is now open. It was opened for the beginning of the Pop Warner season. Dino Mitrokostas, the ServSafe person for the concession stand, donated a great deal of time and materials. Mr. Harrington was informed that opening day was successful.
2. Mr. Harrington stated that the Community Health Center expansion septic system is complete.
3. Glen Harrington stated that the Tribal Government Center septic permit has been issued. The next step will go forward for the Government Center.
DISCUSSION
August 20, 2012 – Household Hazardous Waste Day.
Kalliope Egloff commented that the August 20, 2012, Waste Day saw 250 vehicles representing 286 households. 3,300 gallons, 16,805 pounds, of hazardous waste was collected that day. It was mostly paint and pesticides. Of the 250 vehicles that attended, 121 were from Mashpee. Eighty percent of Mashpee’s participants were year-round residents, 53 percent were new participants. The reason given for attending the hazardous waste day was that 37 percent received brochures, 17 percent received information from the newspaper, 20 percent received information from signs, 11 percent from radio/television/internet, and 13 percent from other sources. Ms. Egloff stated that in other counties residents pay about $25 per vehicle to dispose of their hazardous waste.
September 29, 2012 – Medication Take Back Day.
Kalliope Egloff commented that Mashpee was not a registered participant on the DEA website. Glen Harrington stated that Chief Collins was made aware of the program, but Mr. Harrington has not yet received any feedback. Mr. Harrington will contact Chief Collins and Lt. Read.
Ms. Egloff commented that she would like to see more advertising to increase the rate of participation since it has been low. She would like to have a line of communication between the Board of Health, the Health Department, and the Police Department in advance of this day to make sure that the appropriate advertising and any other information is made public.
October 1, 2012 – Flu Clinic.
Glen Harrington stated that the Flu Clinic will take place at Christ The King Parish Center. There is not enough participation to hold a Flu Clinic at the schools. The students usually receive the flu vaccine from their pediatrician.
September 26, 2012 – Reschedule Meeting.
Burton Kaplan stated that the next scheduled meeting is on September 26, 2012, which happens to be the end of Yom Kippur, a Jewish Holiday. Burton Kaplan commented that the September 26, 2012, meeting will be rescheduled to October 3, 2012.
Mobile Food Carts.
Burton Kaplan stated that Mashpee has a number of Mobile Food Permits that because of zoning issues will now no longer be able to operate as a mobile food cart in the Town of Mashpee.
Glen Harrington commented that the Mobile Food Carts have already operated most of the year, but no mandate to cease operating has been sent to the mobile food carts. This is a Zoning issue, and Town Counsel is working on an amendment to this Zoning issue.
Kalliope Egloff made a motion that the Board of Health adjourn the Public Session, to enter into Executive Session, not to return to the Public Session. Lucy Burton seconded the motion. The motion was unanimously approved.
The public session meeting was adjourned at 8:07 PM.
